§ 153.036. DECISIONS OF THE BOARD OF APPEALS.

- The Board of Appeals may reverse or affirm, wholly or in part, or may modify the order, requirement decision or determination appealed from and shall make any order, requirement, decision or determination as, in the Board’s opinion, ought to be made in the premises and to that end shall have all the powers of the office from whom the appeal is taken. If there are practical difficulties in the carrying out of the strict letter of this chapter, the Board of Appeals may, in passing upon appeals, vary or modify any of its rules or provisions relating to the construction or structural changes in equipment or alteration of buildings or structures or dimensions of buildings or structures so that the spirit of this chapter shall be observed, public safety secured and substantial justice done. The foregoing notwithstanding, the Board’s powers shall not include the hearing of appeals from the decision of the Village Council or Planning Commission unless such specific appeal is authorized herein.(Ord., § 3.7, passed 8-5-1991; Ord. 2012-02, passed - -2012)
