(A) The purpose of this section is to enhance the preservation of the public peace, health, safety and general welfare of the residents of, and visitors to, the village.
(B) It shall be unlawful for any person to create, assist in the creation of, permit or continue to permit the emission of any unreasonably loud, disturbing noise which results in the annoyance, disturbance or injury of others or endangers the comfort, health, peace and safety of others within the village limits.
(C) It shall be unlawful for any person, firm or corporation to play, use, operate or permit the playing of any radio, electronic boom box, stereo, stereo speaker system or other entertainment speakers or other electronic sound devices or sound-producing devices which are inside or outside of any building, residence, commercial building, tavern, restaurant or in a parked or moving vehicle which emits noise in violation of this section. The provisions of this section shall apply to any and all sources of sound except the following exemptions:
(1) Railroad equipment and operation on a railroad right-of-way;
(2) Emergency sounds specifically made to alert persons of the existence of an impending danger or emergency, i.e., sirens, law enforcement loudspeakers and the like; and
(3) Parades, concerts, festivals, fairs or other activities for which a license has been obtained from the Village Council.
(D) As used in this section, NOISE shall be defined as a sound which is plainly audible at a distance of 50 feet from the building, vehicle, structure or other source by any person.
(E) This section, as amended, shall take effect and be in force 20 days after its passage.
